Kodak sues over infringment violation

Kodak has filed a legal patent infringement lawsuit to take action against online photo sharing company Shutterfly, which has in turn responded with its own suit.

At present, Kodak runs a popular online service, namely Kodak Gallery, which faces direct competition from Shutterfly.com. At present, both services invite users to upload photos as well as order prints, create photo books and also emblazon their pictures onto a host of exclusive products which includes calendars and coffee mugs.

In its filing on Monday with the US’ Securities and Exchange Commission, the much smaller Shutterfly confirmed that it has received Kodak’s lawsuit, which was officially filed last Friday. It commented that Kodak, which is officially based in the city of Rochester, N.Y., is pushing for an injunction, as well as damages and costs, which includes legal fees, however the filing doesn’t indicate which particular patents are currently in dispute.

In its filing, Shutterfly expressed its belief that it has the right to take meritorious defenses to Kodak’s action and will defend the matter vigorously to uphold its reputation while also demonstrating that it will not wilt under pressure from Kodak.

On Monday, Shutterfly, which is based in Redwood City, California, confirmed that it has filed its own lawsuit and accused Kodak of direct patent infringement. As well as this, Shutterfly is also looking to seek an injunction, in addition to damages and costs. However, as mentioned, it didn’t elaborate when pressed to comment on the patents that it is trying to protect.
